As the title of this posts suggests, Kanye will indeed be giving away 50 pairs of the “Red” Nike Air Yeezy 2’s via his website. ELIGIBILITY: The Kanye West Air Yeezy Giveaway (“Giveaway”) is open to legal residents of the 50 United States (including the District of Columbia) and Canada (excluding the province of Quebec) age 18 or older at time of entry. The Giveaway and any website pages and advertisements relating thereto, are intended for viewing within the 50 United States and Canada only. Employees of Island Def Jam Music Group, a division of UMG Recording, Inc. (the “Sponsor”), Nike Inc., and their parent, affiliates, subsidiaries, agents, advertising and promotions agencies, and any other individual or company involved in the development or execution of the Giveaway (“Released Parties”) and their immediate families (parents, siblings, children and their respective spouses) and same households of each, whether or not related are not eligible to enter or win. No groups, clubs or organizations may participate in this offer or reproduce or distribute any portion of these Official Rules or entry forms to its members. Method of Entry #2: With an iTunes purchase of the Kanye West Yeezus CD download, follow all onscreen instructions/links to receive your free unique code to access the Giveaway’s entry page. Method of Entry #3: To enter without a CD or download, request a free unique code via email by sending an email during the Entry Period to: code@pushsuport.com. Your free unique code will be sent to the email address your email originated from along with instructions on how to access the Giveaway’s entry page. PRIZES: Each winner will win a pair of Air Yeezy 2 Shoes (Approximate Retail Value (“ARV”): $245.00 (USD) each. The amount of prizes awarded per Weekly Entry Period Drawing is as follows: Weekly Entry Period Drawing #1: Twenty (20) prizes are available to be awarded. Weekly Entry Period Drawing #2: Twenty (20) prizes are available to be awarded. Weekly Entry Period Drawing #3: Ten (10) prizes are available to be awarded. All taxes or other expenses not specified herein are not included and are each winner’s sole responsibility. Limit: One prize per person or household. If actual ARV of prize is lower than the stated ARV when prize is fulfilled, then the difference will not be awarded. Arrangements for the fulfillment of any prize will be made by Sponsor and/or its designated agent. No substitution of any prize offered, no transfer of any prize to a third party is permitted and prizes may not be redeemed for cash value, except by Sponsor, who reserves the right in its sole discretion to substitute any prize for a prize of comparable or greater value. Taxes are the responsibility of each winner.
WINNER SELECTION: Weekly Entry Period Drawing winners will be selected in a random drawing of all eligible entries received for a given Weekly Entry Period. Each Weekly Entry Period random drawing will be conducted at the office of the Administrator, Ventura Associates Intl LLC (60 E. 42nd St., NY, NY) within five (5) business days after the conclusion of each Weekly Entry Period. Ventura Associates Intl, LLC is an independent judging organization (“judges”) whose decisions are final and binding.
ODDS: Odds of winning are determined by the number of eligible entries received for a given Weekly Entry Period.
WINNER NOTIFICATION: Each potential winner will be notified by email, telephone, U.S. mail and/or overnight carrier. The contact information provided on entry will be used to notify winners. Each winner may be required to complete and return an Affidavit of Eligibility and Liability and, unless prohibited by law, Publicity Release (“Affidavit/Release”) as well as any other documents (“Prize Notification Documents”) within five (5) days of date specified on notification, or he/she may be disqualified. Prepaid overnight mailing envelope may also be provided. A parent or legal guardian may be required to complete and return any required document on behalf of any eligible minor. If Affidavit/Release, and/or prize notification or prize is returned as undeliverable or if a prize is forfeited, or if required document(s) are not returned within such time period, or if a selected winner cannot accept or receive the prize for any reason, or if he/she is not in compliance with these Official Rules, the corresponding prize may not be awarded. A prize may be forfeited if winner is not reachable at address or phone number provided or a forwarding address is not made available or any non-compliance with the Official Rules. If a potential winner is a Canadian resident, he/she will be require to correctly answer, without assistance of any kind, a time-limited mathematical skill testing question administered at a mutually agreeable time by telephone. Prize award notices will be sent to each winner approximately thirty (30) days after winner verification detailing when winner should receive prize, which is expected to ship within six (6) months. Except where prohibited by law, entry and acceptance of prize constitute permission for Sponsor, Nike Inc. and their agents to use each winner’s name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.
RELEASES: Entrants agree to these Official Rules and the decisions of the Sponsor and Judges, and on their behalf, and on behalf of their respective heirs, executors, administrators, legal representatives, successors and assigns (“Releasing Parties”), release, defend and hold harmless Sponsor, any entity involved in the fulfillment of the prize(s) or the administration of the Sweepstakes, and their respective employees, officers, directors and agents of each (“Released Parties”), from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Released Parties which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have which in any way arise out of or result from entrant’s participation, acceptance and use or misuse of any prize, including property damage, personal injury or death. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of any prize or for any suspension of the Sweepstakes or inability to implement the Sweepstakes or award the prize as contemplated herein due to any event beyond its control, including delays or interruptions caused by acts of God, acts of war, natural disasters, weather, utility outages, acts of terrorism or any federal, state, or local government law, order, or regulation, order of any court or regulator. This Sweepstakes shall be governed by and interpreted under the laws of the State of New York, U.S.A. without regard to its conflicts of laws provisions. The Sponsor reserves the right to cancel or modify the Giveaway if fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award any prize via a random drawing from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of, or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor is also not responsible for any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the Giveaway. CAUTION: Any attempt by an entrant to deliberately damage Giveaway’s website or undermine the legitimate operations of the Giveaway is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law.
DISPUTES: This Giveaway is subject solely to the applicable federal, provincial, state and local laws of the United States and Canada and is not subject to any laws outside of the United States and Canada; provided, however, that, except where prohibited, by participating in the Giveaway entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved exclusively by final and binding arbitration under the rules of the American Arbitration Association in an arbitration to be held at the AAA regional office nearest the Sponsor where the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; (b) a judgment upon any such arbitration award may be entered in any court having jurisdiction; (c) to the degree any dispute, claim or cause of action arising out of or connected with this Giveaway or any prize awarded is not subject to arbitration, then it shall be adjudicated exclusively by the appropriate Federal or state courts located in New York City, New York, U.S.A; (d) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action; (e) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (f) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased, other than for actual out-of-pocket expenses.
